KMT Hosting – Terms of Service

1. Acceptance of Terms
These Terms of Service ("Agreement") govern the use of all products and services provided by KMT Hosting ("KMT Hosting", "we", "our", or "us").
By ordering, accessing, or using any of our services, you agree to comply with these Terms of Service, our Privacy Policy, Acceptable Use Policy (AUP), and Refund Policy. If you do not agree with these terms, you must not use our services.
2. Services
KMT Hosting provides web hosting, VPS hosting, dedicated servers, domain-related services, cloud infrastructure, and other Internet-related services.
We reserve the right to modify, improve, suspend, or discontinue any service at any time without affecting existing contractual obligations where required by law.
3. Customer Responsibilities
Customers agree to:
Provide accurate and complete account information.
Maintain the confidentiality of their account credentials.
Keep their software, operating systems, and applications updated.
Maintain appropriate backups of all hosted data.
Comply with all applicable local, national, and international laws.
Customers are fully responsible for all activities performed under their accounts.
4. Acceptable Use
Customers may not use KMT Hosting services for activities including, but not limited to:
Illegal activities.
Distribution of malware, ransomware, viruses, or other malicious software.
Phishing or identity theft.
Spam or unsolicited bulk email.
Denial-of-Service (DoS) or Distributed Denial-of-Service (DDoS) attacks.
Unauthorized access to computer systems.
Hosting copyrighted content without authorization.
Fraudulent or deceptive activities.
Content involving child sexual abuse material or any illegal exploitation.
Any activity that threatens the security, stability, or reputation of our network.
Violation of this section may result in immediate suspension or termination of services.
5. Payments
All services are billed in advance unless otherwise agreed in writing.
Invoices must be paid by the stated due date.
Failure to pay may result in service suspension or termination.
Customers remain responsible for all outstanding balances incurred before account termination.
6. Automatic Renewal
Hosting services automatically renew at the end of each billing period unless canceled before the renewal date through the client portal or by contacting our support team.
Customers are responsible for canceling services they no longer wish to renew.
7. Refunds
Refund eligibility is governed by our published Refund Policy.
Unless otherwise stated:
Domain registrations are non-refundable.
Software licenses are non-refundable.
Setup fees are non-refundable.
Dedicated server deployments are non-refundable after provisioning.
8. Chargebacks
Customers agree to contact KMT Hosting before initiating any payment dispute or chargeback.
Initiating an unjustified chargeback for services that have already been provided may result in:
Immediate account suspension;
Service termination;
Recovery of chargeback fees and collection costs where permitted by law.
9. Data Backups
Customers are solely responsible for maintaining independent backups of their data.
Although KMT Hosting may provide backup services, no guarantee is made regarding the availability, completeness, or recoverability of backup data.
10. Service Availability
KMT Hosting makes commercially reasonable efforts to maintain reliable service availability.
However, uninterrupted or error-free service cannot be guaranteed due to scheduled maintenance, emergency maintenance, Internet failures, third-party outages, or events beyond our reasonable control.
11. Suspension and Termination
KMT Hosting may suspend or terminate services immediately if:
These Terms are violated;
Payment is overdue;
Services are used for illegal purposes;
Customer activity threatens network security or stability;
Required by law or governmental authority.
Whenever practical, we will attempt to notify customers before suspension.
12. Intellectual Property
Customers retain ownership of their own content.
Customers represent that they possess all necessary rights and permissions for any material stored or transmitted using our services.
KMT Hosting claims no ownership of customer content.
13. Limitation of Liability
To the maximum extent permitted by applicable law, KMT Hosting shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:
Loss of revenue;
Loss of profits;
Loss of business opportunities;
Loss of data;
Business interruption.
Our total liability shall not exceed the amount paid by the Customer for the affected service during the three (3) months immediately preceding the event giving rise to the claim.
14. Indemnification
Customers agree to defend, indemnify, and hold harmless KMT Hosting, its employees, officers, affiliates, and partners from any claims, liabilities, damages, losses, or expenses arising from the Customer's use of our services or violation of these Terms.
15. Compliance with Laws
Customers agree to comply with all applicable laws and regulations governing their use of KMT Hosting services.
Customers are solely responsible for determining whether their use of our services complies with applicable legal requirements.
16. Modifications
KMT Hosting may update these Terms of Service at any time.
Updated versions will be published on our website with a revised "Last Updated" date.
Continued use of our services after publication constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable to KMT Hosting's jurisdiction, without regard to conflict of law principles.
